Terms of service
Terms of use
These terms apply to your use of Grus (this instance), operated by Robert Metzner, Willdenowstraße 10, Berlin. The software is open source (AGPL-3.0); these terms only cover how this instance is run.
1. The service
Grus is a travel diary: you upload photos, videos and GPS tracks and organise them into trips that you keep to yourself or share with others. We provide the service on a best-effort basis.
2. Account
You need an account and must be at least 16 years old. Give true information, keep your credentials secret and tell us if you suspect your account is being misused. You are responsible for everything that happens through your account.
3. Plans and storage
There is an account with limited storage and a Pro plan with more storage that we enable on request. When the storage limit is reached the service refuses further uploads; existing content is untouched. Use is currently free of charge. Should anything cost money in future, we will agree that with you explicitly beforehand; without such an agreement you incur no costs.
4. Your content
Your content belongs to you. You grant us the simple, non-transferable right to store, encrypt, resize (previews), organise and show it to the people you share it with, as far as needed to run the service. The right ends when you delete the content or your account.
You confirm that you hold the necessary rights to your content and that it does not infringe third-party rights. For photos and videos of people respect their personal rights and, when you share a trip publicly or by link, remember that the content and, with locations on, places are visible to everyone with access.
5. What is not allowed
- Content that breaks applicable law or infringes third-party rights (for example depictions of violence or abuse, hate speech, copyrighted works of others without permission).
- Disrupting, overloading, spying on or attacking the service or other users; bypassing access controls; uploading malware.
- Automated retrieval of large amounts of content (scraping) and passing on your access.
- Misusing the service as plain file storage or a content delivery service.
6. Reports and measures
You can report illegal content to grusapp@robertmetzner.com. We may block or remove content and restrict or suspend accounts that violate these terms or the law or where we are obliged to. We tell you and give reasons unless the law forbids it. You can object to the decision by writing to us.
7. Availability and backups
We aim for stable operation but cannot promise a particular availability; maintenance and outages can happen. The service is not a backup: keep the originals of your photos and tracks and use the data export under Account → Data regularly.
8. Inactive free accounts
Free accounts you have not signed in to for a long time (period stated in the warning email) are deleted after two warning emails to your address. Sign in to prevent that.
9. Ending the agreement
You can delete your account at any time under Account → Data. We may terminate the agreement with reasonable notice and without notice for good cause (for example a serious breach of section 5). We then give you the chance to export your data unless something prevents that.
10. Liability
We are fully liable for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we gave a guarantee. For simple negligence we are liable only for breach of essential contractual obligations (obligations that make the agreement possible and that you may rely on), limited to the typical, foreseeable damage. For loss of data we are liable only to the extent it would have occurred even with regular backups by you appropriate to the risk. Otherwise liability is excluded.
11. Changes
We may change these terms for an objective reason (new features, legal changes). We announce material changes at least four weeks ahead by email or in the service. If you do not object within that period and keep using the service they count as accepted; the announcement says so. You can delete your account at any time.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of your country of residence remain unaffected. If a provision is invalid the rest remains valid.
